In DC Insurrection Case Domenic Pezzola Is Detained Now Argues About Proud Boy Radio and Lockdown

FEDERAL COURT, March 1 – Minutes into a break in the impeachment trial in the U.S. Senate, insurrectionist Domenic Pezzola was ordered detained until trial by Magistrate Judge Robin M. Meriweather. Inner City Press live tweeted it, below.

On February 18, Pezzola has filed for review and release, including: "  While others may be seen with flexicuffs or banging on doors, searching for victims, etc. Pezzola is just seen as one of the crowd walking through the building. There is a selfie video where he lights a 'victory cigar' and mugs for the camera. The implication was he stopped for a cigar because he considered the objective achieved, stopping the certification of the election pursuant to the instructions of the then President. There is no indication that he sought to seek or harm anyone in the Capitol."

On March 1, DDC Judge Kelly held an oral argument, and Inner City Press live tweeted it here:

Judge: Let me drill into the issue of the riot shields. How did Mr. Pezzola come into possession of it? Grand Jury has charged him with "by force and violence... did take from the Capitol Police officer the riot shield." Isn't that sufficient evidence to detain?

Pezzola's lawyer: You can get a Grand Jury to indict a ham sandwich. We have evidence Mr. Pezzola did not bring that shield to the demonstration. Then he's holding it. Did he get it by force? Or pick it up off the ground? There's no officer who says, he took it

Pezzola's lawyer: He had three kids, or two, I can't remember, but he's not a danger to the community, if it is it's de minimus... He's locked down 23 hours a day. There's great security concerns with these guys. His mental health is in jeopardy

 So DDC Judge Kelly has taken it under advisement, whether to release Pezzola

In making that predictive judgment, I had to think if there were conditions, GPS for example

Judge Meriweather: Even real time GPS monitoring, could it deter the risk? He agreed with others to return to this area, to kill whoever they could and the flash drive found in the search of his residence, I conclude he should be detained.

Magistrate Judge Meriweather: Of course, the defendant may appeal this decision to District Judge Kelly. I will issue a written order. I did not make a ruling on flight; danger to the community was enough. AUSA: We'll be before Judge Kelly last Friday in March.

Defense lawyer: How quickly could we appeal?

Judge Meriweather: I'll get the decision out in a couple of days.

everal Capitol insurrection cases featured references not only to former Vice President Mike Pence but also to Antifa. Marissa Suarez and Patrick Alonzo Stedman were before U.S. District Court for the District of Columbia Magistrate Judge G. Michael Harvey and Inner City Press live tweeted, here and here:

Stedman will be hiring his own counsel. US affidavit: "STEDMAN self identifies as a dating and relationship strategist on his Twitter page, under display name Pat Stedman STEDMAN is a frequent Twitter user and as of January 10, 2021 had 25.6K followers."

AUSA: He may travel in NJ, SDNY, EDNY and Eastern District of Pennsylvania. Pre-trial says conditions are OK. Before the proceeding, there was talk of not explaining on the record why.

US: Stedman "discussed his participation in the riots: “I was pretty much in the first wave, and we broke down the doors and climbed up the back part of the Capitol building and got all the way into the chambers.”

In the docket: "In the first image, STEDMAN posted, “Backwards hat (Antifa) right where they were breaking into the main area of Congress.”

and

US: SUAREZ wrote the following: When we found out pence f*cked us, we all stormed the Capitol building and everyone forced entry and started breaking shit.. it was a like a scene out of a movie (9:57 a.m.)

Defense lawyer Boss doesn't how if Staten Island is in SDNY or EDNY (it's EDNY). His client for now is in Florida visiting family.  Judge Harvey: Staten Island is in EDNY, according to Google. AUSA: I searched that too.

More Suarez: "This is one of the antifa f*cks we found..  I actually saw a kid getting ready to throw a jack daniels bottle with some shit in at the cops and I started flipping out on him and then I informed some of the military guys and they handled him."
