In DC Jan 6 Case Pauline Bauer Is Detained After Citing Book of Genesis, Gun

FEDERAL COURT, June 21-- On June 11, months after the DC Circuit's decision in US v. Munchel, DDC  Magistrate Zia Faruqui held a proceeding on Pauline Bauer. He ordred Bauer to appear in person on June 18, pushed back to June 21 by the observance of the Juneteenth Federal holiday.

Judge Faruqui says he hope Bauer answers, so he doesn't "have to find you in contempt" and send her to jail. Wants her to answer if she wants stand-by counsel.

Pauline Bauer does not want stand-by counsel. Judge Faruqui: I relieve you stand-by counsel.

Hernandez: I'm happy to leave right now. If the court were to order Ms. Bauer in contempt, I would ask that the court stay it so it could be appealed to Judge McFadden.

Judge Faruqui: Ms. Bauer, it's clear to me you do not want outside representation, that's in the 6th Amendment. Next, the right to remain silent. And conditions of release.  AUSA Steiner is offering the standard / baseline conditions: No DC except court-related

 Judge Faruqui: We are not going to listen to your 37 pages --

Bauer: The court has no authority over me. Judge Faruqui: Do you oppose the conditions of release? What about travel outside of the US? Bauer: Under my bill of rights, I am not convicted of anything

 Judge Faruqui: This is permitted by the Bail Reform Act. Bauer: I did not harm anyone. Judge Faruqui: Don't talk about that, it might imply you were somewhere where a crime was committed. You are opposing the conditions of release, I don't see why.

Pauline Bauer: I do not see why I am being put into conditions. You let me go five months... Judge Faruqui: I have signed orders letting people go on vacation. You can operate your business. But everyone else is getting conditions. Do you have a firearm?

Pauline Bauer: Why would pre-trial services come to my home? I am a free-living woman. Judge Faruqui: You have to listen.

Pauline Bauer: I want to read this. I am going to read it. Judge Faruqui: You have the keys to your jail cell.  Bauer: You are railroading me.

Judge Faruqui: If you do not agree with moving this case forward, we cannot get there. What about you leave the firearm at your place of business? My Sidbury [pre-trial], would that be ok? Sidbury: No, we visit businesses too. AUSA: No guns in either place.

 Judge Faruqui: She is trying to work with a court the authority of which she was not acknowledge.

Pauline Bauer: I am not a danger. Judge Faruqui: These are just conditions. Your volunteer service is commendable. Bauer: I won't speak with pre-trial services.

Judge Faruqui: You're leaving me no choice. Two options: it's 1:48 now, you can think until 2:30. It would be unfair to treat you differently. If you won't meet with pre-trial, I am going to order you confined.

 Judge Faruqui: US Marshall, I hereby order you confined. We will reconvene at 3 pm.

From June 11: Judge Faruqui ordered Bauer to show up in person in DC on June 18 or face arrest. But now, with the Juneteenth Federal holiday being observed, the showdown has been postponed for at least three days: "MINUTE ORDER as to PAULINE BAUER (2): It is hereby ORDERED that PAULINE BAUER (2) appear IN-PERSON for an initial appearance on 6/21/2021 at 1:00 p.m. in Courtroom 4 before Magistrate Judge Zia M. Faruqui... So Ordered by Magistrate Judge Zia M. Faruqui on 6/17/2021." Watch this site.
 
From June 11: Case of US v. Pauline Bauer tells DDC Magistrate, I am a free soul, I am not part of your corporation, I am making a special Divine appearance. Judge Faruqui demands her to come to DC in person Pauline Bauer: Are you railroading me?

 Judge Faruqui: That's not how you speak to a Federal judge. Pauline Bauer: I am here by special Divine appearance, a living soul. Judge Faruqui: I want to go forward.

Judge Faruqui: Will you answer my questions? Pauline Bauer: Yes. Judge Faruqui: Do you want counsel?

Pauline Bauer: I am here, a free living soul, a woman, and I stand by my notice of special appearance. [Note: #Halkbank tried this  in SDNY]

Judge Faruqui: You have to answer yes or no.

 Pauline Bauer: I stand by my notice.

Judge Faruqui: We tried. You have the right to counsel. Pauline Bauer: I do not want counsel.

Judge Faruqui: I am conducting a Faretta inquiry--

Pauline Bauer: I do not stand under the law. Under Genesis 1, God gave man dominion over the law.

 Judge Faruqui: You have a Constitutional right. Pauline Bauer: I do not want counsel.

Judge Faruqui: This is only going to work in person. Come to DC on June 18. If you can't, file something. Or I'll issue a bench warrant.

 Pauline Bauer: I do not consent.

Judge Faruqui: You can sign off Ms. Bauer.

Pauline Bauer: I have a question - is this public?

 Judge Faruqui: Yes. See you next week, 1 pm. Pauline Bauer: And if I do not?

Judge Faruqui: A bench warrant. Pauline Bauer: You took an oath to the Constitution.

Voice: There is a standby counsel, Ms. Hernandez

Pauline Bauer: I do not want Mr. Hernandez. No No NO

Judge Faruqui: I have removed Ms. Bauer from this proceeding. I appoint Ms. Hernandez as stand-by counsel. Are you vaccinated?

Hernandez: Yes
