FEDERAL COURT, Sept 17 -- On June 11, months after the DC Circuit's decision in US v. Munchel, DDC  Magistrate Zia Faruqui held a proceeding on Pauline Bauer. It did not go well.  Inner City Press live tweeted it here and below. Song here. He ordered Bauer to appear in person on June 18, pushed back to June 21 by the observance of the Juneteenth Federal holiday.

On June 21, Judge Faruqui held an in-person proceeding with Bauer - and detained her for criminal contempt. Inner City Press live tweet that here, podcast here.

Now on September 17, District Judge Trevor N. McFadden held a proceeding and ordered Pauline Bauer detained. Inner City Press live-tweeted it here (podcast here)

Judge McFadden denied Bauer's Sovereign Citizen motion. AUSA: We want to revoke Ms. Bauer's pre-trial release... We have given her documents over USAfx. [Note: Inner City Press has asked DOJ for the videos in Torrens and Munchel, but doesn't have them - #fail

Pauline Bauer: I've had nine months of this dog and pony show. The Capitol Police were letting people in. You have put in on my PACER account. These videos are available. Under a Constitutional court there must be a corpus delecti. A dead entity cannot be a victim

Judge McFadden: Sounds like you want to resolve this and don't want to wait 60 days. Let's come back in a month. Bauer: I have a business to run, I have to take two days off to come here. No one wants to work - they are all taking unemployment.

 Judge McFadden: Next is Oct 29, 2 pm. Appointed stand-by counsel: Ms Bauer has filed a motion for me to cease & desist. Judge McFadden: I would like you to stay on. Ms. Bauer, will you sign this? Bauer: That would put me back in the water but I am already on land.

 Bauer: If this was an official proceeding, why was AOC six blocks away? I was not the first person into the Capitol.  Judge McFadden: Ma'am I'm going to ask you to sit down. Bauer: I am not a citizen. I am one of We The People, the Creators of the Government.

 Pre-Trial Services: She is not amenable to supervision. AUSA: Ms. Bauer was supposed to report weekly, but has only done so twice. Judge McFadden: You have not allowed Pre-Trial Services to tour your home.

Bauer: I'm presumed innocent. I have put myself on land. Bauer: I don't have a list of what they took from my house. They stole from me. They are lying.  Judge McFadden: The main -- Bauer: They showed up without telling me. I was at work. I am not shutting my business down for a tour of my home.

Bauer: The FBI has been watching me since Day One. I am at my restaurant 15 hours a day and when I am not, I don't want to be around people. I am not a danger. I have affidavits from people there on January 6.

 Judge McFadden: Do you agree you have not been in contact with Pre-Trial? Bauer: I do not agree. I do not want to go back into the water. Judge McFadden: Will he remain in contact with Pre-Trial? Bauer: I don't want to make a tacit agreement.

Judge McFadden: I find a violation, failed to maintain contact with Probation. Ma'am you need to sit down now. She is unlikely to comply. You believe you are above the law. I find your release should be revoke. I'll ask the Marshals to take you into custody.

 Pauline Bauer (screaming) Stand-by counsel: Could we wait? Judge McFadden: No. I have no confidence she will maintain any conditions of release. She is going to be incarcerated.

Back on June 22, after Bauer spent the night in DC Jail at 1901 D Street, SE, she appeared again before Judge Faruqui. Without signing anything, and saying she would drive to Mount Rushmore from June 30 to July 15, she was released. Inner City Press again live tweeted it, below.

  Now weeks later, the assigned stand-by counsel has disclosed that Bauer has still not been given access to her discovery, videos. Apparently, the US Attorney's Office for DC, which gives USAfx access to select media, hasn't given this defendant (or other Press which have requested) any access. What is going on here? "Counsel has sent an email to Ms. Bauer advising her of the discovery production. However  the videos themselves are too large to email.

 Accordingly, there are several options for providing Ms. Bauer with the discovery. Either the government could grant access to Ms. Bauer to the USAfx platform; or it could upload the videos and other discovery onto an external hard drive or USB flash drive and mail these directly to Ms. Bauer. Alternatively, undersigned counsel could undertake the responsibility of delivering the materials to Ms. Bauer by mail or by uploading the discovery to a secure cloud based platform similar to USAfx but whose access is not controlled by the USAO. 3 Counsel awaits the Court’s direction on the role it wishes standby counsel to undertake on discovery and other pretrial issues."

Now on July 19, this: "Minute Entry for proceedings held before Judge Trevor N. McFadden: Status Conference as to PAULINE BAUER held on 7/19/2021. PAULINE BAUER (2) permitted to represent herself. Attorney Carmen D. Hernandez will remain as stand by attorney. PAULINE BAUER (2) directed to allow Pretrial Services Agency to conduct a virtual or in-person visit within the next two weeks. PAULINE BAUER (2) further directed to surrender her passport, if found. PAULINE BAUER'S (2) [42] Motion to Dismiss, DENIED. Status Conference set for 9/17/2021 at 10:30 AM in Courtroom 2- In Person before Judge Trevor N. McFadden."

From June 22: Judge Faruqui: The conditions would be to turn in your firearms, until your court case is over. You have 2d Amendment rights. If you will say you will comply, I will release you.

 Pauline Bauer: I am one of God's creations... 

 AUSA Steiner: Since Ms. Bauer is proceeding pro se, it may take some time to agree on a protective order. Is email the best way to reach her? Judge Faruqui: She can email or mail or bring it to the courthouse. Pauline Bauer: I tried yesterday.
