Myers Who Pleaded Guilty To Bank Fraud Got Arrested Now 6 Months in In-Person Sentencing

By Matthew Russell Lee, Patreon Podcast
BBC - Guardian UK - Honduras - ESPN

SDNY COURTHOUSE, Jan 26 – Glen Myers was charged with bank fraud and identity theft. Then while out on bond, he was arrested.

On January 26, U.S. District Court for the Southern District of New York Judge Lewis J. Liman held a proceeding. Inner City Press called in, then reported it, here. Then on March 25, when Judge Liman conducted an in-person sentencing, Inner City Press went to near-empty Courtroom 15B to cover it, see below.

On January 26, Assistant US Attorney Benjamin Schrier chided Myers' lawyer Jeffrey Shabrowe for having sought a loosening of conditions of release without conference with Pre-Trial Services.

In fact, "especially in light of Myers' arrest over the past weekend," a request was made for tightened conditions.

Judge Liman ruled that Myers should be subject to 24 home confinement and not permitted to leave home for work, in Mount Vernon or anywhere else.

When the sentencing took place on March 25, Inner City Press went to the courtroom. Judge Lyman let his mother speak, which is rare in sentencings. She had submitted a letter that her son's help, on her health and dog-walking.

AUSA Schrier recounted the arrests while on pre-trial release: January 1, 2020 assault in East Orange, NJ; July 17, 2020, marijuana arrest in Perry, Georgia without consent; January 17, 2021, high speed chase in Newark.

Judge Liman was very polite with the defendant's mother, but said that a modest period of incarceration was necessary to promote respect for the law. The guideline was six to 12 months.

Judge Liman arrived at six months, to begin on May 24. He wished the defendant well, telling him he can be a productive member of society. TD Bank will be getting (back) $21,870. The proceeding was over, and the courthouse nearly empty.

The case is USA v. Lyons, 20-cr-152 (Liman)
