Guardian Life Is Under ERISA But Argues It Should Never Have Been Filed in SDNY

SDNY COURTHOUSE, Sept 20 –Kimberly Jedlicka sued the The Guardian Life Insurance Company Of America for its refusal to pay long term disability benefits due under ERISA.  

      On September 8, 2022, U.S. District Court for the Southern District of New York Judge John P. Cronan held a proceeding. Inner City Press covered it. 

 The arguments were about venue, with the defense counsel saying this should never have been filed in SDNY.

Afterward, on September 12, Judge Cronan in the docket asked for supplemental briefing on venue. These were filed on September 16.

The case is Jedlicka v. The Guardian Life Insurance Company Of America, 22-cv-3869 (Cronan)
