NFL Is Sued For Failure of Its Game Pass Livestream Now Tries To Pass Buck to OverTier

SDNY COURTHOUSE, April 5 – The National Football League has been sued by a man in Australia, aiming to form a class action for the NFL's GamePass crashing during the Super Bowl between the Kansas City Chiefs and the San Fransisco 49ers.  

 The complaint states that "the live stream crashed and displayed an error message."

Later, the NFL offered subscribers $10 payments, in local currency. But the complaint calls the Super Bowl live a non-replaceable good.  

The case has been assigned to U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer, and Inner City Press is covering it. 

On September 3, 2021 the NFL's lawyers filed motion for a stay pending their motion to dismiss.

Jump cut to April 5, 2022. Now the NFL is arguing that it is not responsible, that it had interposed OverTier and Deltatre. Judge Engelmayer asked questions about privity, and express some doubt.

The case is Gill v. National Football League, et al., 21-cv-1032 (Engelmayer)
