Tarrytown Kitchen Accident Triggers Insurance Lawsuit Speeded Up in SDNY

SDNY COURTHOUSE, August 26 – A kitchen cabinet fell off a wall in 12 Tappan Landing in Tarrytown, New York on April 26, 2018. A state lawsuit followed, and now a federal case about insurance.       

    On August 26 U.S. District Court for the Southern District of New York Judge Jed S. Rakoff held a proceeding. Inner City Press covered it. 

Arizona-based insurer Southwest Marine has sued Erie Insurance Company for allegedly breaching its duty to defend and indemnify Freeform Construction Corp.

Judge Rakoff asked the parties why they needed so much time to start discovery and do the limited number of deposition. He shortened the time for both.

The case is Southwest Marine and General Insurance Company v. Erie Insurance Company, 21-cv-4869 (Rakoff)
