Volvo Truck Hit 2008 Mercedes in Queens Now SDNY Lawsuit With Daubert Looming Over Experts

SDNY COURTHOUSE, Nov 17 –  Omar Lahbabi was driving his 2008 Mercedes on 58th Street in Queens when a Volvo truck owned by A Duie Pyle, Inc. hit the car. A lawsuit ensued.      

     On November 17, U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer held a proceeding. Inner City Press covered it.  

 Judge Engelmayer said he would only one this one extension of discovery, and that the parties were taking the risk their proposed experts might be excluded under the Daubert case.

 He acknowledged that no responsible lawyer could agree in advance to not depose the other side's expert, before knowing what the expert would say. 

  Judge Engelmayer set a next conference for February 11 at 4 pm.

The case is Lahbabi et al v. Soler et al., 21-cv-3765 (Engelmayer)
