Millstein of Emigrant Sued Hurley Citing Domestic Violence Now Sloppy Jury Trial Request

SDNY COURTHOUSE, May 11 –  Howard Milstein's Emigrant Bank and its Fiduciary Network sued Mark P. Hurley in December 2018 seeking among other things "a declaration that it does not owe Hurley approximately one million five hundred thousands dollars in legal fees he has demanded from the Company stemming from its investigation into the circumstances surrounding his arrest for domestic violence in November 2017." 

 The case was removed to the U.S. District Court for the Southern District of New York and on May 11, 2020 SDNY Judge Gregory H. Woods held a pre-trial conference which Inner City Press covered. 

   One issue was whether the error had been made in not explicitly requesting a jury trial. But the other issue is when jury trials will begin again in the SDNY.

  Judge Woods, precise as ever, said that the default position will be a jury trial. He set a schedule for summary judgment motions and predicted that he will be back in his chambers, if not courtroom, in two months time. Inner City Press will be here.
