In Case of Injury at Bronx Hospital Lack of Candor Alleged Then Excused in SDNY

SDNY COURTHOUSE, August 6 – U.S. Specialty Insurance Company sued Massachusetts Bay Insurance Company for indemnification of STB Housing Development in an underlying action by Russel James for injury at St. Barnabas Wellness Care and Affordable Housing Project on 183rd Street and Third Avenue in The Bronx.  

  On August 3, 2022 U.S. District Court for the Southern District of New York  Judge Paul A. Engelmayer held a proceeding. Inner City Press covered it.

   The main issue was the behavior of counsel, in what Judge Engelmayer called a lack of candor and non-service of the client(s).

Apologies were offered. Judge Engelmayer ultimately accepted it, stating that he was advocating for the clients as to their counsel, and set a schedule. For summary judgment, September 2 to October 14.

The case is U.S. Specialty Insurance Company v. Massachusetts Bay Insurance Company et al., 21-cv-10590 (Engelmayer)
