Mercedes
Wolff sued
Texas
Roadhouse
Holdings, LLC
for a slip or
trip and fall
at their
restaurant in
New Rochelle,
one of their
five hundred
restaurants.
On November
28, 2022, U.S.
District Court
for the
Southern
District of
New York Judge
Paul A.
Engelmayer
held a
proceeding.
Inner City
Press covered
it.
Defense
counsel said
she planned to
ask to
extended the
expert
discovery
deadline, set
to expire in
two days.
Judge
Engelmayer
said this was
unacceptable.
After
a lengthy
discussion, he
agreed that
more expert
discovery
could be
useful, and
noted that
injuries at
other related
restaurants
might be
relevant.
When
defense
counsel
recounted that
the plaintiffs
had no surgery
but was suing
for $250,000
Judge
Engelmayer
emphasized
that he did
not want to
hear this, as
he might
preside over a
trial. He
referred the
matter to
Magistrate
Judge Robert
W. Lehrburger
for
settlement.
On
the litigation
track, the
defendant's
motion for
summary
judgment was
scheduled for
January 13.
