LIRR Case May Go To Trial in SDNY Oct 5 Is So Exhibits Must Be In Hard Copy For Jury

SDNY COURTHOUSE, Sept 28 –  Michael Menzies sued the Long Island Railroad Company, where he worked as a radio technician untli May 24, 2018.          

     On September 28 U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it. 

Judge Koeltl noted that they still have their October 5 trial date, but no one knows if it will actually happen, given the COVID era scheduling and the prioritization of criminal cases with detained defendants.

  Still, if the trial does go forward, Judge Koeltl ordered the parties to be sure to bring hard copies of exhibits.

Counsel responded that in another SDNY case a USB of exhibits had been sent into the jury room.

  Judge Koeltl said his way is to give the jurors only those exhibits they ask for, so in hard copy, not USB or laptop.

The case is Menzies v. Long Island Railroad Company, 19-cv-11235 (Koeltl)
