Man From Yemen Sued US For Revoked Passport Now US Wins Summary Judgment

SDNY COURTHOUSE, May 31 –  Mansoor Hamoud Hadwan was a resident of NYC until he says the US unlawfully revoked his US passport, forcing him into exile.

Through a Bronx based law firm he sued in 2017. Inner City Press covered it.  

Hadwan's lawyer said she is overworked and asked until July 15 to file a briefing.

Judge Pauley said that was absurd, and settled on July 1. He began to tell a story about lawyers saying they didn't have their schedules before their electronics had been taken at the courthouse entrance, but Hadwan' lawyer cut in.

   AUSA Brandon Waterman filed a response for the US Embassy in Sana'a, Yemen.

Jump cut to May 31, 2022: "CLERK'S JUDGMENT re: [151] Memorandum & Opinion in favor of United States Department of State, United States Embassy, Sana'a, Yemen against Mansoor Hamoud Hadwan. It is hereby ORDERED, ADJUDGED AND DECREED: That for the reasons stated in the Court's Opinion and Order dated May 27, 2022, Defendants' motion for summary judgment is GRANTED. Plaintiff has impermissibly premised some of his claims on new arguments not raised during the administrative process and has abandoned other claims, both explicitly and by failing to respond to Defendants' arguments. In sum, Plaintiff has offered no evidence to convince the Court that Defendants' revocation of Plaintiff's passport and CRBA was arbitrary and capricious. That said, that Court takes the Government at its word that it will consider, if submitted, DNA evidence that proves Plaintiff is actually the child of Hamoud Hadwan and is, therefore, entitled to a United States passport; accordingly, the case is closed."

 The case was Hadwan v. United States Department of State et al., 17-cv-578 (Caproni).
