In SDNY Bautista Supported By Iraq Veteran Spouse Ordered Released Despite 1 Kilo Brick

SDNY COURTHOUSE, Dec 9 – Past six pm on Friday December 6 Leonardo Bautista was presented on charges of conspiracy to distribute narcotics in connection with a one kilogram brick of heroin or fentanyl, questioned by U.S. District Court for the Southern District of New York Magistrate Judge Barbara Moses.    

  Assistant US Attorney Matthew Hellman acknowledged that the tests on the brick were not complete. But he disputed that Bautista would necessarily be safety valve eligible, and asked that he be detained.

    In the Magistrates Court gallery was Bautista's spouse, an Iraq War veteran, ready to sign any bond.

     After questioning AUSA Hellman about the brick, Judge Moses ruled that Bautista could be released but only upon the satisfaction, after the weekend, of conditions including Pre Trial Services conducting a home visit in The Bronx. There must be three financially responsibile co-signers. Judge Moses remarked that the difficult cases come in after close of business on Friday. 

The case is US v. Bautista, 19-mj-11431 (Moses).
