In SDNY 2 Men Presented on Heroin Conspiracy 1 in Withdrawal No Exclusion of Time

SDNY COURTHOUSE, Feb 18 -- On February 13, Christian Irizarry and Antonio Reyes were indicted for heroin conspiracy and their arrest warrants signed by Magistrate Judge Robert W. Lehrburger of the U.S. District Court for the Southern District of New York.  

On February 18 the duo was presented before SDNY Magistrate Judge Barbara Moses, each with CJA lawyer who consented to their detention without prejudice. The lawyer for Reyes, a/k/a Tone, said that Reyes was undergoing heroin withdrawal. Judge Moses told the lawyer to approach, he needn't say this is open court. Inner City Press, as at the end of last week before Judge Lehrburger, was the only media in the Mag Court.   

The case has been assigned to District Judge Gregory Woods, who will hold the arraignment on February 21 some time between 10 and 2 pm.

The Assistant US Attorney asked that Speedy Trial Act time be excluded until then, but that is not the law. Time cannot be excluded until arraigment, Judge Moses and the AUSA's colleague concurred. The case is US v. Irizarry and Reyes, 20-cr-127 (Woods / Moses).
