Second Ave Ale House Is Sued For Basement Bathroom But No One Uses It These Days

SDNY COURTHOUSE, May 29 – Jose Mario Perez has sued Sam's 2nd Avenue Ale House for having its bathroom in the basement inaccessible to him and others in wheelchairs.

   On May 29 defense lawyers alleged that Perez and counsel may never have visited the Ale House, which they said is open for curbside service but not of alcohol - something that is allowed or happens in the outer boroughs.  

 Judge Liman, who held a proceeding that Inner City Press covered on May 29, said fact discovery is due by September 29. After that, who knows?

The case is Perez, Jr. v. SRP Management LLC et al., 19-cv-11736 (Liman).
