In SDNY Tale Of 2 Co Defendants One Detained Other Freed 12 Kilos Heroin Pregnant Girlfriend

SDNY COURTHOUSE, March 10 -- Two defendants arrested with 12 kilos of heroin were presented before U.S. District Court for the Southern District of New York Magistrate Judge Ona T. Wang on March 10. The first, called Mister Rosado, consented to detention.

  The second, a 21-year old referred to as Mr. Del Villar, made a bail application. Despite the 12 kilos of heroin, his lawyer emphasized that his client had only minimal contacts with Mexico, had a pregnant girlfriend and no criminal record. He said his client might be eligible for the safety value.

    Assistant US Attorney Brett Kalikow said the defendant told Pre Trial Services he'd only been to Mexico one recently to see a sick uncle, but it is in fact 10 to 15 times. He cited repeated California to New York travel and said the safety value is unlikely.

    Judge Wang after a 20 minute break returned and granted bail to the defendant. She told him it was because of his youth, lack of record and impending family. Hours after the proceeing, the case was still not in PACER. It is, or should be, US v. Rosado, et al., 20-mj-2699 (Wang).
