In SDNY Mag Court Lopez Arraigned While His Indictment Still Sealed

SDNY COURTHOUSE, July 10 – Past 6 pm on Friday July 10 a proceeding was held by U.S. District Court for the Southern District of New York Magistrate Judge Sarah Netburn. Inner City Press covered and live tweeted it.

A defendant in custody was named - "Lopez" - with an "S2" indictment. 

 But it had not been unsealed. The initial indictment named another defendant, Emiliano Bomba, in money laundering and narcotics charges.

Judge Netburn initially told Lopez he was charged with both crimes, then only the narcotics.  

 Lopez was said to be detained on consent.

  Then later, without explanation, this was filed: Minute Entry for proceedings held before Magistrate Judge Sarah Netburn: Initial Appearance as to (S2-19-Cr-463-4) Andy Garibaldi Lopez held on 7/10/2020. Date of Arrest: 7/10/2020. AUSA Sebastian Swett. Defense Counsel Jennifer Willis (Federal Defenders). Spanish Interpreter needed. BAIL DISPOSITION: Agreed conditions of release; $100,000 PRB; 2 FRP; Travel restricted to SDNY/EDNY/District of Maryland, NDNY and points in between for employment purposes; Surrender travel documents (& no new applications); Pretrial supervision as directed by Pretrial Services; Drug testing/treatment as directed by PTS; Defendant to continue or seek employment; Defendant to be released on own signature; Remaining conditions to be met by 7/31/2020. No contact with co-defendants unless in the present of counsel. Control date set for 7/24/2020. ADDITIONAL PROCEEDINGS: Defendant arraigned; pleads Not Guilty. Speedy Trial Time excluded under 18 U.S.C. Section 3161(h)(7) until 7/24/2020. (bw)."

The case is US v. Bomba, 19-cr-463 (Cote / Netburn)
