In Dakota Plains Securities Case Decertifying Class Disfavored So Daubert Focus in SDNY

SDNY COURTHOUSE, Aug 3 –   In a securities case pending since 2016, about those who bought Dakota Plains securities from 2012 to 2016, on August 3 U.S. District Court for the Southern District of New York Judge William H. Pauley III held a proceeding. Inner City Press covered it. 

 There was a request to file a motion to decertify the class.

Judge Pauley said that would not be a good use of time, though the parties were free to do it. He recommended they focus on motions of summary judgment on the the "Daubert" / expert issues.

The case is Jon D. Gruber v. Ryan R. Gilbertson, et al., 16-cv-9727 (Pauley)
