As Photographer Sues Real Estate Agency For Using Photo Agent Claims Harassment in SDNY

SDNY COURTHOUSE, July 26 – Photographer Brian Totin sued Oxford Property Group and Sagi Pariente for misusing his photographs of apartment on Manhattan's Upper West Side.    

   On July 26, U.S. District Court for the Southern District of New York Magistrate Judge Katharine H. Parker  held a proceeding. Inner City Press covered it.  

 After some delay in one of two Feldman's calling in, the Feldman representing Pariente said there was no basis for suing his client, who has counter-claimed for harassment.   Judge Parker pointed out that harassment is not a tort.

This Feldman said he might then amend to seek Rule 11 sanctions.

You'd have to follow those procedures then, Judge Parker said. But of course.

  A settlement conference has been set for September 24. It will, of course, be closed door.

The case is Totin v. Oxford Property Group LLC et al., 21-cv-3129 (Engelmayer / Parker)
