Dale Left Hedgeye Risk Management Then Injunction Denied Now Two Defendants Added

SDNY COURTHOUSE, June 24 – Darius Dale left Hedgeye Risk Management LLC on March 28, 2021 Now there is a dispute about what information he can and cannot use.   

     On July 28, 2021 U.S. District Court for the Southern District of New York Judge Andrew L. Carter held a proceeding. Inner City Press covered it.

 At issues are source files, divided into Bucket A (Hedgeye's orginal files) and Bucket B (derived, developed from them). Dale is enjoined from using A, but not B.

There is to be quarantining, which Hedgeye protested they don't see how it can work.

On November 2021 Judge Carter held another proceeding and Inner City Press again covered it. Judge Carter denied any injunction, finding no irreparable harm.

  In February 2022 there were emergency requests to the assigned Magistrate Judge Robert W. Lehrburger to crack down on use of discovery material in the case, including on Twitter. A conference was held on February 15, and Inner City Press covered it. The parties were urged to not further publicize any discovery, and to say nothing for the next two weeks.

   Online we find this, for example. It was noted that this business is conducted on Twitter, so these are like press releases. The magistrate disagreed.

On June 24 Dale filed a request with Judge Carter for leave to file a sur-reply, saying that "contrary to Hedgeye's assertions, Hedgeye's aggressive discovery positions have frequently been rejected... and Defendants have, of course, not refused to appear for deposition."

On July 19 Magistrate Judge Robert W. Lehrburger held a conference, and Inner City Press again covered it. Judge Lehrburger issued an order that the deadline for fact discovery is extended to December 2, to accommodate the addition of Terman and Solstein as defendants.
