Borland Took $1M+ in Fraud Then Belize Delay Now Sentenced to 84 Months and Paying $26M

BBC - Guardian UK - Honduras - The Source

SDNY COURTHOUSE, Oct 5 –   Brett Borland after being charged with securities fraud over $1 million, which he used on beach club membership had a proceeding on August 5 before U.S. District Court for the Southern District of New York  Judge Failla. Inner City Press live tweeted it:

This is not your average SDNY sentencing proceeding. Borland's submission at footnote 3 says "through his legal action in Belize against Caruso, Borland seeks to ensure that not only the 40 investors who cut a deal are made whole, but also Copper Leaf."

In ongoing Borland proceeding, a lawyer chimes in that he lost video but is still on by audio. Judge Failla quips, "I thought you had something better to look at."

Judge Failla: Was the Belize conduct "relevant conduct"?   It seems sentencing will be delayed until this Belize issues is resolved...

Judge Failla says, You have misled me. The delay is not based on the SEC, but on Belize litigation... She says this has taken 2 1/2 hours and it turns out it is *not* the Fatico hearing.

Now on May 11, the sentencing has been pushed all the way back to October 5: "MEMO ENDORSEMENT as to Brent Borland on [100] LETTER by USA as to Brent Borland addressed to Judge Katherine Polk Failla from Negar Tekeei/Edward Imperatore dated May 10, 2021 re: Opposition to Motion for Adjournment of Sentencing. ENDORSEMENT: The Court is in receipt of Defendant's letter motion for a further adjournment of sentencing (Dkt. #99) and the Government's above response in opposition (Dkt. #100). Defendant's request is GRANTED. Sentencing is ADJOURNED to October 5, 2021."

On October 5 Judge Failla held the sentencing, and Inner City Press covered it. Borland was sentenced to 84 months in prison, and to pay $26 million. There will be three years of supervised release.

The case is US v. Borland, 18-cr-487 Failla)
