Felon in Possession Hightower Got Four Months & Six Days Now Probation Cites Heroin Again

SDNY COURTHOUSE, March 31 – Charleton Hightower, a felon in possession of a firearm, was up for sentencing on April 14, 2021.

U.S. District Court for the Southern District of New York Judge Richard M. Berman held the sentencing on the CourtCall platform. Inner City Press covered it.  

 Judge Berman, on a guideline of 37 months, imposed a sentence of four months and six days, to give the defendant's family time to prepare to help him. 

 But when defense counsel pushed back at the electronic device search condition, saying it was for sex offenders, not felons in possession, Judge Berman disagreed.

He imposed the electronic device search condition, during three years of supervised release.

On March 14, 2022, Judge Berman held a supervised release proceeding. He inquired into the management / landlord of where Hightower is living, heard testimony about fentanyl and heroin, and advised that Hightower should be accompanied to a meeting with Social Security on March 30. He set a next conference for March 31.

On March 31, Inner City Press again covered the case. Probation said there's been no progress on SSI and said that heroin is again being used. Judge Berman asked about the simultaneous use of heroin and methadone. A next conference was set for April 19.
