Hylton Pled Guilty To Rape Now Detention For Deportation Argued In SDNY 3d Circuit Cited

SDNY COURTHOUSE, Nov 23 –  Gabrae Hylton pleaded guilty to third degree rape in 2007 and now is detained facing deportation by ICE. He sued.

  On November 23 U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it, live tweeting that Judge Koeltl says his deputy knows the head of  @Bronxdefenders , but that won't impact the case.

Hylton has been detained for 10 months and wants a bond hearing.

 Judge Koetlt: You're asking me to read Velasco-Lopez as authority in the 2d Circuit I should indicate to the immigration authorities should be followed in this case.

But shouldn't the immigration judge be doing that as a fair reading of the law in this Circuit?    Bronx Defenders cited a Third Circuit case, 965 F.3d 203.

Judge Koeltl questioned whether the immigration judge would in fact hold a hearing and apply the right standard.

He took the case under advisement, to rule later.

The case is Hylton v. Decker et al., 20-cv-5994 (Koeltl)
