Sal 79 Is Sued For Not Paying Overtime Cites COVID Problems But Not Bankrupt Like Gyms

SDNY COURTHOUSE, Sept 23 – Julio Tellez Garcia sued Sal 79 Associates, Inc. and its restaurants including Coppola's West and Coppola's East for failure to pay overtime.

   On September 23 U.S. District Court for the Southern District Judge Katherine Polk Failla held a proceeding. Inner City Press covered it.  

  Judge Failla explained to the parties that for the foreseeable features, there can be only three jury trials at once in the SDNY courthouse.    The defendants' lawyer talked about how hard business is under COVID.

Judge Failla said she's seen bankruptcies of gyms but not yet restaurants. (From another case Inner City Press covered on September 23, before SDNY Magistrate Judge Parker, fish markets should be added to the list of businesses bankrupted and foiling settlements). 

 Judge Failla said she'll ask Magistrate Judge Fox and order a settlement conference in either October or November.

The case is Garcia et al v. Sal 79 Associates, Inc. et al., 19-cv-1301 (Failla)
