Obese 71 Year Old Man Who Kidnapped At 61 Seeks Reduction in Sentencing In SDNY

SDNY COURTHOUSE, Nov 4 – Walter Garcia is 71 and in prison; he wants a reduction in sentencing. 

    On November 4 U.S. District Court for the Southern District of New York  Judge Jed S. Rakoff held an oral argument. Inner City Press covered it.  

The AUSA pointed about the defendant's crime, kidnapping, was committed when he was 61 years old, so the mitigating effect of age could not be relied on here.

 It was noted he's obese.

  Judge Rakoff listened then thanks the parties for their advocacy.

He noted he has a civil jury trial (MiMidx' Parker Petit and Bill Taylor) that runs to the end of November and said he'll rule soon after that.

The case is USA v. Garcia, 11-cr-989 (Rakoff)
