IBM Sued For Age Discrimination Before SDNY Judge Koeltl His John Doe Case Still Secret

SDNY COURTHOUSE, Oct 29 – Brad Calerdon was let go by IBM and has sued saying it was because he was over 40. IBM replied that his whole unit was fired including a 28 year old.

  On October 29 with only Inner City Press present in the gallery of the courtroom of Judge John K. Koeltl of the U.S. District Court for the Southern District of New York, defense was made by IBM's lawyers from Jackson Lewis P.C. of, appropriately, 666 Third Avenue. The case is Caleron v. IBM, 19-cv-6792 (Koeltl).

Anthony Bruno was a sale manager at Macy's in Yonkers when on September 17, 2017 the escalator in Macy's stopped abruptly. Bruno fell forward and was injured.

 More than two years later the case arrived in the
U.S. District Court for the Southern District of New York courtroom of Judge John G. Koeltl, with only Inner City Press in the gallery. Bruno's lawyer seemed unclear on where his client had been living at the time.

Judge Koeltl as he often does asked why the case was here in Foley Square and not, say, in White Plains. Bruno's lawyer Richard DePonto of B&M Law said his office in White Plains, he would not object. The lawyer for the defendant Schindler Elevator Corporation, from Connell Foley someone affiliated with Judge Koeltl said he knows, said it would be fine to move the case.

  She indicated that the stopping of the escalator, far from a malfunction, was what was supposed to happen when a plate was pushed indicating someone might be pulled through.

  Judge Koeltl reviewed the case management plan but said he would look into move in the case to White Plains. There is a now long ago (August 7) criminal presentment from which he ordered Inner City Press out which has yet, to our knowledge, to be disclosed.
