In Ghislaine Maxwell Giuffre Case USVI Motion to Intervene Opposed So Reply Sept 23

SDNY COURTHOUSE, Sept 16 – Ghislaine Maxwell used the United Nations, as reported by Inner City Press whose questions about it UN Secretary General Antonio Guterres refuses, see below.

 On September 1 to U.S. District Court for the Southern District of New York Judge Loretta A. Preska the US Virgin Islands filed this motion: "Virginia L. Giuffre, Plaintiff, Case No.: 15-cv-07433-LAP v. Ghislaine Maxwell, Defendant. / THE GOVERNMENT OF THE UNITED STATES VIRGIN ISLANDS’ NOTICE OF EX PARTE MOTION TO INTERVENE AND FOR CONFIDENTIAL ACCESS TO JUDICIAL RECORDS AND DISCOVERY DOCUMENTS PLEASE TAKE NOTICE THAT, upon the pleadings and papers in this matter, the accompanying Memorandum of Law, and the exhibit annexed thereto, Proposed Intervenor the Government of the United States Virgin Islands (the “USVI”) respectfully moves this Court, before the Honorable Loretta A. Preska, for an order pursuant to Federal Rule of Civil Procedure 24 granting the USVI’s motion to intervene and for confidential access to judicial records and discovery documents. The grounds for this motion are set forth in the accompanying memorandum of law. Dated: September 1, 2020."

On September 2, Judge Preska ordered: "The Court is in receipt of the motion to intervene in the above-captioned action and for confidential access to judicial records and discovery documents which was filed by the Government of the United States Virgin Islands (the "USVI"). (See dkt. no. 1110.) The parties may, but are not required to, comment on the USVI's motion no later than September 16, 2020. The USVI may reply to any comment by the parties no later than September 23, 2020."

 Now on September 16, Maxwell's lawyer Laura A. Menninger has opposed the intervention, stating inter alia that "Now that Ms. Maxwell has been indicted, there is no question that all discovery material must remain subject to the protective order." Reply is sue September 23.

In last August, Judge Preska ruled on a protocol: "In accordance with Brown v. Maxwell, 929 F.3d 41, 49-51 (2d Cir. 2019), the Court will conduct an individualized review of each Sealed Item in the List of Decided Motions to determine (a) the weight of presumption of public access that should be afforded to the document, (b) the identification and weight of any countervailing interests supporting continued sealing/redaction, and (c) whether the countervailing interests rebut the presumption of public access. To assist in this process and afford persons identified or otherwise interested in the Sealed Materials the opportunity to participate in the Court’s individualized review, the Court adopts the following protocol.

1. Non-Parties List: Plaintiff Virginia Giuffre and Defendant Ghislaine Maxwell (collectively, the “Original Parties”) each have submitted under seal a list of non-parties whose privacy, reputational or other interests may be implicated by the unsealing of the Sealed Materials (each, a “Non-Party,” and collectively, the “Non-Parties”).

Because the Original Parties did not agree on one or more Non-Parties to be included in the list, the Court has resolved all such disagreements and shall issue to the Original Parties a Court-approved Non-Parties List, which shall be sealed. The Non-Parties shall include but are not limited to: (a) persons who produced or answered discovery based upon the representation or understanding that the discovery would be subject to the Protective Order previously issued in this action; (b) persons who are identified as having allegedly engaged in sexual acts with Plaintiff, or other alleged victims, or allegedly facilitated such acts; (c) persons whose intimate, sexual, or private conduct is described in the Sealed Materials; and (d) persons who are alleged to have been victimized.

The Non-Parties List will: • Identify each Non-Party by his or her name, which correlates to a unique pseudonymous identifier, i.e., Doe #1, Doe #2, and Doe #3.

• Provide the address or contact information for each Non-Party or his or her legal counsel, which the Original Parties identified to the best of their ability. 2. Judicial Adjudication: Because of the volume of Sealed Materials, the Court will conduct an individualized review of several Sealed Items at a time, thereby allowing the review to proceed on a rolling basis and in a manageable fashion. The Court will review sealed items based on the Non-Party mentioned in the Sealed Materials. For example, for Doe #1, the Court would review each Sealed Item that mentions Doe #1, and would do the same for Does #2, #3, etc. This will allow the Court more easily to manage and review any objections from NonParties. The following procedure shall be used for each set of Sealed Items reviewed by the Court: a. The Court will notify the parties via minute order (“Notification”) of the set of Sealed Items that will be considered. The Court will consider input from the Original Parties as to the number of Sealed Items that is appropriate to consider at once in light of the volume and complexity of the Sealed Items. b. As soon as practicable after the Notification the Original Parties shall confer and shall use their best efforts to cause each Non-Party mentioned in the Sealed Materials to be considered to be served confidentially with the Non-Party Notice. The Non-Party Notice is attached to the original Order and Protocol for Unsealing Decided Motions (dkt. no. 1044) and has been approved by the Court. “Best efforts” entails identifying the most current address available for the nonparty in a public records database or other readily available source. Service shall be effected via first class certified mail, return receipt requested. After service, the party causing the service shall file a certificate of service, stating the date and method of service and identifying the Non-Party by his or her pseudonymous identifier.

c. Within 14 days of service of the Non-Party Notice, a Non-Party, identified by his or her pseudonymous identifier, may submit to the Court a request for excerpts of the Sealed Materials pertaining to him or her (the “Excerpts”). The form request attached to the original Order and Protocol for Unsealing Decided Motions (dkt. no. 1044) has been approved by the Court and shall be attached to the Non-Party Notice." We'll have more on this.

  Now while UNEP official Lisa Svensson appears in the documents unsealed July 30 in the U.S. District Court for the Southern District of New York which Inner City Press covers since ousted from the UN by Guterres for is reporting, Inner City Press is continuing its exclusive 2018 reporting in Svensson's "Volvo Boating" and other scams at UNEP, here, where we published in full, on Scribd and Patreon, the agreement with Volvo Ocean Races signed by Erik Solheim, here, and the EUR 500,000 agreement signed by UNEP's Lisa Emilia Svensson, here and here. From the March 1, 2018 UN transcript, four months before Guterres has Inner City Press physically ousted from the UN: Inner City Press: I also wanted to ask you about UNEP (United Nations Environment Programme).   Whistleblowers there have alleged a number of irregularities, but the one that caught my eye and I've published has to do with the allegation is that UNEP, which claims under Mr. [Erik] Solheim to have a number of corporate partnerships is, in fact, in some cases paying the corporation for the partnership.  I.e., it's not a partnership like, you know, Barcelona Football Club with UNICEF, where they pay.  In this case, they're alleged that, under Mr. Solheim, the UN Environment, as it's now called, is paying $500,000 to Volvo Ocean Races.  And I wanted to know is it… one, I don't know if it's true, but they work there and they have a lot of names and a lot of information. Spokesman:  I think you can ask those questions directly of UNEP.  I have no doubt that Mr. Solheim is operating and running the agency in accordance to all relevant rules and regulations." Right.

Here's from the letter: "Dear Mr. Solheim...  a D1, Lisa Svensson can work from Europe, because for personal reasons she does not wish to work in Nairobi.  Her big office in Nairobi remains vacant with her name and organisational equipment while the same has to be provided again by another office in Europe.  She leads the marine team remotely as the rest of the staff under her responsibility are in Nairobi. 

   As Inner City Press first reported, long time UN operative Amir Dossal, UNSG Antonio Guterres' chief Partnerships official who was also his link to UN bribers like Ng Lap Seng and Patrick Ho of CEFC China Energy, was on the board of directors of Maxwell's shadowy Terramar. Inner City Press first made this link & published the 990. And here is Dossal introducing Maxwell as one of her nine visits to the UN, here.

   After the death of Jeffrey Epstein in the MCC prison, on July 2 Acting US Attorney for the Southern District of New York Audrey Strauss announced and unsealed in indictment of Maxwell on charges including sex trafficking and perjury.

   Inner City Press went to her press conference at the US Attorney's Office and asked, Doesn't charging Maxwell with perjury undercut any ability to use testimony from her against other, bigger wrong-doers? Periscope here at 23:07.

  Strauss replied that it is not impossible to use a perjurer's testimony. But how often does it work?

  At 3:30 pm on July 2 Maxwell appeared in the U.S. District Court for the District of New Hampsire, before Magistriate Judge Andrea K. Johnstone. Inner City Press live tweeted it here.

 What they did not mention is something Inner City Press has been asking the UN about, as under UNSG Antonio Guterres with his own sexual exploitation issues (exclusive video and audio) it got roughed up and banned from the UN: Ghislaine Maxwell had a ghoulish United Nations press conference, under the banner of the "Terramar Project," here.

 On July 5, after some crowd-sourcing, Inner City Press reported on another Ghislaine Maxwell use of the United Nations, facilitated by Italy's Permanent Representative to the UN, UN official Nikhil Seth and Amir Dossal, who also let into the UN and in one case took money from convicted UN briber Ng Lap Seng, and Patrick Ho of CEFC China Energy, also linked to UN Secretary General Antonio Guterres.

  At the Ghislaine Maxwell UN event, the UN Deputy Secretary General was directly involved.

Antonio Guterres claims he has zero tolerance for sexual exploitation, but covers it up and even participate in it. He should be forced to resign - and/or have immunity waived.

  Terramar has been dissolved, even though Maxwell's former fundraiser / director of development Brian Yurasits still lists the URL on his (protected) Twitter profile, also here.

  But now Inner City Press has begun to inquire into Ghislaine Maxwell's other United Nations connections, starting with this photograph of another day's (or at least another outfit's) presentation in the UN, here. While co-conspirator Antonio Guterres has had Inner City Press banned from any entry into the UN for two years and a day, this appears to be in the UN Economic and Social Council (ECOSOC) chamber.
