SDNY COURTHOUSE,
Jan 5 – Solomon Sharbat sued
Iovance Biotherapeutics for
"willful failure and refusal
to pay fees."
On October 19, 2021 U.S.
District Court for the
Southern District of New York
Judge Edgardo Ramos held a
proceeding. Inner City Press
covered it.
Iovance
argued that incoming
substitute plaintiff's counsel
should not be allowed, as he
might be a witness.
They wrote,
"Plaintiff Sharbat has
testified under oath that Mr.
Schwartz instructed him to lie
in a FINRA enforcement
proceeding and physically
assaulted him and threatened
his life.
On
November 16, Judge Ramos held
another proceeding. Inner City
Press again covered it. There
were arguments that Sharbat
was not required to make
sales, but only connections,
under his contract.
On January
5, 2022 Judge Ramos held
another conference in the
case, with the defense now
complaining about Sharbat's
new lawyer and even saying
that the previous lawyer had
given the defense a
declaration that they were
withdrawing due to their
client's failure to follow
advice.
Causes of
action were dismissed, but the
new counsel did get a brief
extension for discovery, to
January 19.
