SDNY by the Tony Buzbee Firm,
including one by a
then-employee of Ecko Clothing
for alleged assault in then
retaliation by Macy's.

On January 17,
2025 Macy's filed a motion to
dismiss, arguing among other
things that "Macy’s does not
argue that same-sex rape can
never be motivated by gender
animus, but Plaintiff alleges
that Mr. Combs, who is the
same gender as plaintiff, had
a history of violence,
including sexual violence,
against both men and women, as
well as a history of using
violence as a tool of business
competition. Plaintiff also
alleges that during the
assault Mr. Combs made remarks
reflecting racial animus and
intimidation of a business
competitor, but not reflecting
