FEDERAL
COURTHOUSE,
May 2 – As Mahmoud Khalil was
sent to the ICE detention
facility in Elizabeth, NJ -
and then it seems to Louisiana
- his lawyer filed a habeas
corpus petition in the U.S.
District Court for the
Southern District of New York.
It was not viewable on PACER
but it was, at terminals in
the courthouse itself. On

(later, on X)
On March
10 it was assigned to Judge
Jesse M. Furman who ordered:
"a joint letter, no later than
March 11, 2025, at 5:00 p.m.,
indicating whether the
conference is necessary and
addressing how the Court
should handle the present
Petition."
The letter was
filed just before 7 pm, noting
the US Attorney's Office's
assertion is disputes on
jurisdiction and possibility
transferring the case, but
still asking for the
conference on March 12.

On March 13
respondent Joyce amended his
declaration, on Patreon here
On March 14
opposing return Joyce wrote in
that "Khalil could not be
housed at Elizabeth Detention
Facility long-term due to the
bedbug issue," filing on
Patreon here.
On March 19 Judge
Furman ruled that "the Court
agrees with the Government
that Khalil’s Petition cannot
be heard in this District.
On March 28 U.S.
District Judge Michael E.
Farbiarz in New Jersey heard
arguments then ruled that
Jersey venue is proper.
Jump cut to May
2, when Judge Farbiarz set a
12:30 pm teleconference with
the parties, but did not list
any public listen-only call-in
line. Inner City Press has, in
writing, asking his Chambers
that going forward in the case
- he refused interlocutory
appeal - public listen-only
call-in lines be specified in
the docket. Some say that his
Chambers selecting who would
be provided a Teams link - and
who would not - is better than
nothing. Rules of public
access are rules - watch this
site.
