Bank Fraud Charge Brought Guilty Plea Now No Jail Time After Lead Defendant Moved to Suppress

SDNY COURTHOUSE, Nov 5 –  Henry Ogbuokiri is charged with bank fraud and aggravated identity theft. 

    On May 19, U.S. District Court for the Southern District of New York Judge Katherine Polk Failla held a change of plea proceeding. Inner City Press covered it. 

Ogbuokiri said he deposited fraudulent checks.

His lawyer said he's south of New York, so travel to the plea proceeding was avoided.

 On November 5, 2021, Judge Failla held the sentencing for Daryl Bartley, who previously pled guilty. He is sick and made a pitch for no jail time. Judge Failla noted his 26 criminal justice points, criminal history level six, resulting in a 27 month guideline. But showing compassion she decided on home incarceration, with the threat of jail as enforcement. She said, I hope I don't see you again in this context.

Meanwhile on September 23 Judge Failla held a proceeding for the named defendant, Oladayo Oladokun. It focused on the government's ability to search a car if officer saw inside a bank deposit slip. The defense said this is too broad. The AUSA said that even seeming innocent items could be used in this scheme.

The case is US v. Oladokun et al., 20-cr-3 (Failla)
