SDNY COURTHOUSE,
Feb 4 –
Patrick Ndukwe
was indicted
for defrauding
Medicaid with
his company
Quality
Services
Medical.
On
March 10, U.S.
District Court
for the
Southern
District of
New York Judge
Denise L. Cote
held a change
of plea
proceeding.
Inner City
Press went and
covered
it.
Ndukwe, with
two lawyer,
admitted to
charging for
rides that did
not take
place.
Judge
Cote asked
about the
interstate
element. The
Assistant US
Attorney cited
a server in
California,
and Western
Union payments
to
co-conspirator
Michelle
Martin, which
Ndukwe then
confirmed. She was
still slated
to go to
trial.
The
plea was
accepted and
sentencing set
for June 30 at
2 pm.
On
March 24, Michelle
Martin appeared
before Judge
Cote and pled
guilty, saying
she had been
in Syracuse at
the time, but
the medical
transports had
been in The
Bronx. Her
sentencing was
set for July 6
at 2 pm.
Judge
Cote said,
with a smile,
that she had
brushed
up on a honest
services fraud
law, a field
evolving
faster than
that of
aggravated
identity
theft.
On June
30, Judge Cote
sentenced
Ndukwe to 60 months
(five years)
in prison,
followed by
three years of
supervised
release.
On July 6,
Judge Cote
sentenced
Michelle
Martin to 10
months in
prison
(recommending
as close to
Syracuse NY
as possible)
and restitution
of $196,467 -
joint and
several with
Ndukwe and
David Travers.
Jump
cut to
February 4,
2025 when Ndukwe's
request for
reconsideration
of the denial
of his
petition for a
writ of habeus
corpus was
itself denied.
