Yonkers Man Charged With Crack Conspiracy so Mason 60 Months Now Release Bid Docket

SDNY COURTHOUSE, May 22–  Johnny Perez a/k/a Ghost was detained on crack conspiracy charges.        

       On January 13, 2022 U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer held a proceeding on Perez's request to be released. Inner City Press covered it. 

 The request cited the spread of COVID in the MDC; Perez' lawyer said he would not reside in Yonkers used for the charge conduct but rather a three bedroom apartment in The Bronx.

 Judge Engelmayer affirmed the Magistrate Court decision to keep Perez detained.

Jump cut to October. Co-defendant Davon Mial starts trial October 17, and the courtroom will be partially sealed. Inner City Press was unaware of the October 3 hearing - some District Court have centralized public notice of sealing requests, rather than a needle in a hay stack - but continued to follow the case.

On October 24, after jurors asked for transcripts to buy videos, lab reports, and "GX 3005 in larger form," they returned guilty verdicts on all counts, with Count 1 put between 28 and 280 grams.

And on November 2, Perez was sentenced: "JUDGMENT IN A CRIMINAL CASE as to Johnny Perez (1). THE DEFENDANT: pleaded guilty to count One (1). IMPRISONMENT: Ninety-six (96) months."

On November 4, co-defendant Aaron Starks got 72 months: "JUDGMENT IN A CRIMINAL CASE as to Aaron Starks (2). THE DEFENDANT: pleaded guilty to count One 1 (1). IMPRISONMENT: Seventy-two (72) months."

On November 16, co-defendant Robert Mason was sentenced to 60 months, to begin on January 10, 2023: "JUDGMENT IN A CRIMINAL CASE as to Robert Mason (7). THE DEFENDANT: pleaded guilty to count One (1) of the Indictment. IMPRISONMENT: Sixty (60) months. The court makes the following recommendations to the Bureau of Prisons: The Court recommends that the defendant be designated to FCI Allenwood, or, failing that, a facility that is capable of providing vocational programs. The Court also recommends that the defendant be placed in any vocational programs, especially in the fields of construction, specifically carpentry, plumbing and electrical, for which he Is eligible. The defendant shall surrender for service of sentence at the institution designated by the Bureau of Prisons: @ before 2 p.m. on 1/10/2023."

Jump cut to May 22, 2025 when Robert Mason has submitted an application, but emails must be docketed to be considered: "ORDER as to Robert Mason: The Court has received a new compassionate release motion filed by counsel for defendant Robert Mason. Dkt. 364. The Court directs the Government to respond by Thursday, June 5, 2025. Defense counsel separately supplied the Court, by email, with a May 21, 2025 email exchange between counsel and Mr. Mason. If counsel wishes that email to be considered in connection with the new compassionate release motion, it must be filed on the docket of this case. (Signed by Judge Paul A.
