Man with 144 Months in
Prison FOIAs His Case But Is Told
FOIA Does Not Apply to Courts

COURTHOUSE,
June 13 – A man sentenced to
144 months in prison on drug
charges in 2023 now in June
2025 wrote in to request
records about his case under
the Freedom of Information
Act, a statute Inner City
Press routinely uses.
U.S.
District Court for the
Southern District of New York
Jesse M. Furman wrote on the
letter, "The Freedom of
Information Act does not apply
to the Courts. Thus, the
request is denied."
He
nevertheless directed the
Clerk to mail the defendant a
copy of his docket
sheet.
The defendant had
requested counsel to apply for
a reduction of sentence but
was denied in February 2024 -
number 64 in the docket - as
"there is no right to counsel
in connection with a motion
for reduction of sentence and
because proceedings in this
Court have concluded."
The case
is, or was, USA v. Dejesus,
1:21-cr-564 (Furman)
