Worker Injury at 291 Broadway in 2020 Triggers Federal Lawsuit Against Berkshire Hathaway

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Sept 1 – Orin Jones was injured while working for G.C. Plumbing & Heating Inc. at 291 Broadway in lower Manhattan on August 11, 2020.

More than three years later on September 1, 2023 the insurance fall-out came before U.S. District Court for the Southern District of New York Judge Ronnie Abrams. Inner City Press covered it.

Berkshire Hathaway is declining to provide defense and indemnity coverage in a lawsuit in NYS court.

Allied World Assurance Company brought the Federal lawsuit for a declaratory judgment that Berkshire Hathaway must do so.

The case management plan has depositions being completed by January 5, 2024.

Judge Abrams set a next conference for January 12 - and asked for a letter in a week.

The case is Allied World Assurance Company (U.S.), Inc. v. Berkshire Hathaway Direct Insurance Company, 23-cv-3801 (Abrams)
