Supervisee Assaulted on Way to Rehab & Phone Stolen Didn't Call Probation Now Detained

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Nov 15 – Tarell McIlwain was sentenced to 21 months in prison in 2018 on gun charges. Since that term and release, he has had a number of violation of supervised release proceedings.

On November 15, McIlwain was brought before U.S. District Court for the Southern District of New York Magistrate Judge Robert W. Lehrburger on VOSR. Inner City Press was there, the only media in the SDNY Mag Court.

His Federal Defender asked that he be released on bond, saying that he hadn't called Probation because during a delay in being admitted to rehab, he had been assaulted and robbed of his phone.

Judge Lehrburger noted that the next proceeding is in two days, and ordered him detained.

The case is US v. McIlwain, 17-cr-385 (Engelmayer / Lehrburger)
