COURTHOUSE,
July 1 – A defendant arrested
in January with $300,000 in
cash in his car (then drugs
and a gun) on April 15 was
before U.S. District Court for
the Southern District of New
York Judge Jennifer H.
Rearden. Inner City Press was
there. Thread:
AUSA: For now
there is a ten year minimum.
But with 89 more grams of
fentanyl, we'll supersede to
15-year minimum. We believe he
is a Dominican national, here
illegally - we may have
another charge.
AUSA: There was a
gun, and the bag of cash
Judge: I saw the
photos. Was there also a
magazine?
AUSA: Yes, next
to the gun. Defense: We're
waiting to see probable cause,
and the supposed consents to
search
Judge:
Trial date Sept 16.
On July 1 defense
counsel filed a 28 page
affidavit seeking to suppress
defendant's statements at 1463
Stadium Avenue for lack of
Miranda warning, then all
evidence obtained in
violations of Mapp.
The case
is USA v. Garcia, 1:25-cr-115
