Erit Shyti Was Charged With Hobbs Act Robbery & a Gun Now Plead Guilty so Dec 17

SDNY COURTHOUSE, Sept 17 – Erit Shyti was arrested on charges of Hobbs Act robbery and, separately as count 2, use of a gun. 

  On July 27, 2023 Shyti was brought before U.S. District Court for the Southern District of New York Magistrate Judge Valerie Figueredo. Inner City Press was there, the only media in the SDNY Mag Court.

  The Assistant US Attorney began by saying her Office wanted to dismiss count 2 of its own complaint.

 She said that a consensual search of the defendant's home had determined that it was not a firearm but a b-b gun. 

 If a real gun, it would have been expected the Office would argue for, and probably obtain, pre-trial detention, on danger to the community grounds.

 But now the Office did not seek detention, instead agreeing to release on unsecured bond. 

On December 15, after multiple orders to continue, the case was indicted and wheeled out to Judge Jennifer L. Rochan. Meanwhile a bail hearing was set for December 19 at 10:30 am before Magistrate Judge Willis.

That was moved to before Judge Rochon at 11:30 pm. Inner City Press was there. Judge Rochon gave until January 3 to get the co-signers in place, and was understanding (as was Pre-Trial Services) about a de minimus location monitoring discrepancy, amid grieving.

On February 21, 2024, the US Attorney's Office wrote it asking to adjourn the February 28 conference for 60 days, saying "the parties are discussing a potential pre-trial resolution of the case."

On September 5, Shyti's counsel wrote in, calling it a joint submission, moving a September 17 conference to September 11 and referring to "the defendant's anticipated guilty plea."

It did not happen on September 11, amid Judge Rochon's FTC v. Tapestry hearing, but rather on September 17, the day that hearing ended. After the plea, sentencing was set for December 17 at 11 am.

 The case is US v. Shyti, 23-cr-667 (Rochon)
