Man Charged For Shooting
Bullet Into Apartment Below Now
US Wants 15 Months

COURTHOUSE,
Oct 31 – Franklyn Then
was arrested on September 24,
2023 accused of shooting a
bullet through the floor of
his apartment into the
apartment below (the occupants
called the police).
On February
9, 2024, Then was arraigned
before U.S. District Court for
the Southern District of New
York Judge Jed S. Rakoff,
whose courtroom Inner City
Press was
covering.
The initial
charging document had a photo
of the handgun at issue, and
bullets. The charge is felon
in possession.
On May 23, Then
pled guilty.
Jump cut to
October 21, when Then's
Federal Defender wrote in
asking for a non-incarceratory
sentence on October 28.
The US Attorney's
Office wrote in asking for 15
months, with sentencing now
set for November 4 at 2 pm.
The case is USA
v. Then, 1:24-cr-73 (Rakoff)
