Man Who Pleads Guilty to
Drug and Gun Charges Is Not
Remanded with MDC Jail Cited

Feb 5 – A man who pled guilty
to drug and gun charges faced
presumptive or mandatory
remand to jail by U.S.
District Court for the
Southern District of New York
Judge John G. Koeltl on
February 5. Inner City Press
was there, the only media in
the courtroom.
The
Federal Defender acknowledged
the remand statute but cited
the conditions in the MDC
Brooklyn jail, her 24-year-old
client's compliance with
previously conditions of
released, and health.
She cited SDNY Judge Jesse M.
Furman's Chavez ruling.
The
Assistant US Attorney said
that the Chavez case was a
year ago, and the MDC has
improved. The Federal Defender
countered with the case of a
29-year-old whose treatment in
MDC was much delayed.
Judge
Koeltl said he did not have
enough information and would
leave the defendant out on
bond, unless otherwise
notified, until his June 11
sentencing.
