COURTHOUSE,
May 6 – A man named Eduardo
Suazo Nunez a/k/a Francisco
Cruz is charged with illegal
reentry of the United States
in an indictment in the U.S.
District Court for the
Southern District of New York.
SDNY Judge Lewis J. Liman held
a conference on March 29.
Inner City Press was there,
the only media in the
courtroom.
Inquiry
made into an audio file in the
possession of ICE. Judge Liman
offered to issue an order to
try to get it; the AUSA said
he may write in for
that.
The Federal
Defender said the case will
turn on that audio, and a
possible motion. She said she
does not anticipate it going
to trial.
On August 8, 2024
the Federal Defender wrote in
asking for another 60 days,
for the remainder of the
records from the Executive
Office of Immigration Review
(EOIR).
Jump cut to May
2, 2025 when the Federal
Defenders moved to exclude
fingerprint expert and the use
of the word "alien" at the
trial set for May 19.
On May 5 the US
Attorney's Office wrote in and
said "based on discussions
with defense counsel, they are
unable to provide additional
information about defendant's
whereabouts" - and that he
might not appear for trial.
On May 6 Judge
Liman granted the request and
canceled the trial. There will
be a status conference...
The case
is USA v. Suazo Nunez,
1:24-cr-186 (Liman)
