SDNY
COURTHOUSE,
April 10 – For a violent
arrest on Eighth Avenue near
14th Street back on March 20,
2016, two NYPD officers were
sued.
On April 9, 2025
- more than nine years after
the arrest - a civil jury was
shown video of the incident in
a trial before U.S. District
Court for the Southern
District of New York Judge
Jennifer L. Rochon. Inner City
Press was there, the only
media in the
courtroom.
The
defendant on the stand
described the plaintiff as
large and hard to subdue; he
said that a loose handcuff
could be dangerous. When the
defense tried to show video
from the arrest at the
precinct it was on its side.
Plaintiff's counsel said he'd
lend his laptop but it had
privileged material on it, in
preparation of closing. He
offered to share it the next
day. Trial was adjourned for
the day.
On April
10 in closing arguments the
plaintiff's lawyer emphasized
to the jury that the
defendants admitted striking
his client, and downplayed the
arrest mugshot they showed.
The case is
Banyan v. Sikorski, et al.,
1:17-cv-4942 (Rochon)
