SDNY COURTHOUSE,
Sept 4 –
In New York
City when
there is a
shooting,
often the
charge is for
being a felon
in possession
of a gun or
bullet, in
order to
Federalize it.
On July 13
federal
prosecutors
announced
"charges
against AUSTIN
MORRISHOW and
CURTIS WHITE
for possessing
ammunition
after
conviction of
a
felony.
MORRISHOW and
WHITE were
congregated
outside on a
busy sidewalk
in the Bronx
the Friday
before the
July Fourth
holiday
weekend when
they fired
multiple shots
at three cars
in the Bronx,
New York,
hitting and
seriously
injuring a
five-year-old
child sitting
in the
backseat of
one of the
cars.
WHITE was
arrested this
morning in
Hazleton,
Pennsylvania,
pursuant to a
criminal
Complaint and
was presented
earlier today
in the
Southern
District of
New York
before U.S.
Magistrate
Judge Ona T.
Wang.
MORRISHOW
remains at
large."
Inner City
Press was in
the U.S.
District Court
for the
Southern
District of
New York
Magistrates
Court, the
only media
there, when
White was
presented on
July 13. He
got a Federal
Defender, who
said he
consented to
detention.
The case had
yet to be
indicted.
On
July 27, the
case was
indicted and
wheeled out to
Judge Paul A.
Crotty.
On
November 8,
Curtis White's
lawyer wrote
it to say that
that subpoena
return was
provided that
day, and that
"given the
volume of the
newly
disclosed
materials...
we ask that
the Court set
a conference
in early
January 2024."
Jump-cut
to September
4, 2024: the
case has been
transferred to
Judge Loretta
A. Preska, who
held a
conference
with both
defendants.
Inner City
Press was
there.
Afterwards, "
Trial
scheduled for
January 6,
2025 at 10:00
am. Time is
excluded from
today, until
January 6,
2025 from
calculation
under the
speedy trial
act."
During the
proceeding,
the prosecutor
said that
talks on a
pre-trial
disposition
are underway,
with the trial
date as a
back-up.
The
case is now US
v. Morrishow,
et al.,
23-cr-383
(Preska.)
