Man Charged As Felon with Ammunition Detained With Ghost Gun Cited Now 26 Months

SDNY COURTHOUSE, Sept 11 -  In the U.S. District Court for the Southern District of New York on June 22, 2022 a detention or release proceeding was held by Magistrate Judge Gabriel W. Gorenstein on a defendant charged with being a felon in possession of ammunition. Inner City Press was there.

  The key, Judge Gorenstein said, was the photo on the defendant's phone of him with a ghost gun, and the vials of crack cited by the Assistant US Attorney.

  Sergio Cepeda's lawyer pointed out that the actual charge is possession of ammunition, that his client's sister and brother in law were in the gallery (where Inner City Press was), and that he worked for the Department of Transportation.

    But there was no answer about the photo of the gun. Judge Gorenstein ordered pre-trial detention.

Jump cut to September 11, 2023. Cepeda had pleaded guilty, without a plea deal. He was up for sentencing before District Judge Lorna G. Schofield, and Inner City Press was again there.

  Probation recommended 30 months, on a guideline of 30 to 37. Judge Schofield imposed a sentence of 26 months, and some heartfelt advise.
