Man Who Pled
Guilty Admitted to Smoking Pot Day Before
Now Sentence Commuted

SDNY COURTHOUSE,
Jan 21 – Victor Martinez
called in to plead guilty to
crack charges on Monday, March
1. When asked, he said he had
"smoked a bowl" of marijuana
the morning
before.
U.S.
District Court for the
Southern District of New York
Judge Mary Kay Vyskocil asked
Martinez what time he had
smoked.
Between 8
and 9 a.m., was the answer -
more than 24 hours before. The
Assistant US Attorney said her
Office did not oppose going
forward with the plea.
But once it was
accepted, after reference to
confidential informants and
video, the AUSA said Martinez
should be remanded to prison,
particularly given an
admission of violating the
conditions of release.
Judge
Vyskocil granted a defense
counter-proposal, to
self-surrender two weeks after
Martinez was interviewed for
the pre-sentencing report.

January 21 2025, docketed,
sentence commuted: "Executive
Grant of Clemency by USA as to
Victor Martinez. The president
commuted the sentence of the
defendant to a term of 40
months imprisonment while also
remitting up to $10,000, if
any, the unpaid balance of any
fine or restitution remaining
at the end of the sentence
while leaving intact any term
of supervised release or other
component of the sentence."
