NYS Case Warrant without Lawyer

SDNY COURTHOUSE,
March 15 – Brian Washington,
previously jailed for failure
to register as a sex offender
as required, is now detained
for violations of supervised
release.
On March
15, 2023 U.S. District Court
for the Southern District of
New York Judge George B.
Daniels held a proceeding.
Inner City Press went and
covered it.
Washington's Federal Defender
said he was prepared to plead
guilty to two specifications,
including public lewdness,
while not contesting three
other charges or specification
still pending in NYS court in
Queens.
It emerged
that Washington had exposed
himself to his treatment
provider. While Federal
Defenders proposed release to
a halfway house or
"residential re-entry center,"
Probation was recommending 12
month in prison.
Judge
Daniels said more jail, absent
mental health treatment, might
do little, even for specific
deterrence. The threat of jail
can be more effective than
jail itself, he added. He was
told that treatment would no
longer be sought, due to
"incidents," from Empire
Forensics or New York Mental
Health, but rather from a male
doctor at New York Forensics.
Judge Daniels adjourned
sentencing until April 26,
before which he wants a draft
order, and information about
the halfway house and the
pending state case in Queens.
In that case, the
18-B lawyer said he was only
appointed (or paid) for
arraignment. So far neither
Legal Aid nor Queens Law
Associates has picked up his
state case.
