SDNY COURTHOUSE,
Sept 5 – Mali Wilkerson is
imprisoned in Marcy
Correctional Facility. He has
sickle cell anemia and has
been prescribed opioids.
But he was told
that Marcy "does not prescribe
opiods." His lawyers moved for
a conference in the wider
prison conditions case he is
in.
In that wider
case a trial, or something
like a trial, was scheduled to
begin on September 5, 2023. On
September 1 there was a final
pre-trial conference before U.S.
District Court
for the
Southern
District of
New York Judge
Loretta A.
Preska. Inner
City Press
covered it.
There
was bickering
about the
caption, and
about how long
for post-trial
briefs. Judge
Preska said 7
days, as she
has a criminal
trial starting
on September
13. One
witness will
be picked up
by car
service. The
pain
continues.
In the
trial on
September 5,
2023, Richard
Vasquez
testified by video
about
operations on
his hips, and
writhing on a
plastic chair
recounting
how only aspirin was
offered. By
whom, he was
asked. Sarah Ferguson,
he said.
He was asked,
so you mean Amy Ferguson?
"I must
have been thinking
of the
Dutchess of York," he
said. There was
laughter in
the courtroom.
Back on May
27, 2022 Judge Preskaheld a
proceeding. Inner City Press
covered it.
The
defendants said that his
prescription was there and the
opiods should be available.
Plaintiff's counsel said that
has not been the case.
Judge
Preska said no one should want
someone to suffer over a three
day weekend needlessly. She
told the defendants to make it
happen.
After the
conference the plaintiff's
lawyers wrote in that "I was
just contacted by Mr. Keane
and Ms. Stanford who spoke
with Dr. Zaki at Marcy. They
indicated Mr. Wilkerson's
medications would be delivered
to the facility by tonight..
This
reality, of course, belies any
notion that Mr. Wilderson had
access to the medication prior
to today's conference."
