SDNY COURTHOUSE,
May 17 – In
June 2021 OFER
ABARBANEL was
charged with
securities
fraud and wire
fraud in
connection
with
ABARBANEL’s
scheme to
defraud
investors in a
mutual fund he
founded and
controlled.
On
May 17, 2023
Abarbanel was
up for
sentencing
before U.S.
District Court
for the
Southern
District of
New York Judge
Louis A.
Kaplan. Inner
City Press was
there and
covered it.
Abarbanel's
lawyer
emphasized
that his
client gave up
a tennis
career to
serve in the
Israeli Army,
and took care
of his wife's
two son from a
previous
marriage, one
of whom was
present for
sentencing.
He
started
describing
advice his
client got -
when Judge
Kaplan asked,
Then why did
he plead
guilty? Why
indeed.
Because
there is no
advice of
counsel
defense here,
the lawyer
said. His
689-page
submission was
initially
questions by
Judge Kaplan.
Ultimately
Judge Kaplan
sentenced him
to four years
in prison.
The
case is
US v.
Abarabanel,
21-cr-532
(Kaplan)
