SDNY COURTHOUSE,
May 23 – Eric
Orozco was
sentenced to
10 years in
Federal
custody in
2008. In May
2022, now in
New York State
prison in
Woodbourne,
NY, Orozco
mailed a
handwritten
letter seeking
to start
proceedings on
violations of
supervised
release from
2016.
On
May 17, 2022,
U.S. District
Court for the
Southern
District of
New York Judge
Lewis A.
Kaplan issued
an order that
"The Court is
advised that
there is no
supervised
release
violation
charged, there
is nothing for
this Court to
'help to
start.'
Denied."
But on May 23,
2023, Eric
Orozco was
brought before
SDNY
Magistrate
Judge Barbara
C. Moses - on
violations of
supervised
release from
2016. Inner
City Press was
there, the
only media in
the SDNY Mag
Court.
Before the
formal
proceeding
began, Judge
Moses summoned
into the
Magistrate
Judges' robing
room Eric
Orozco's
Federal
Defender, who
had also
represented
him in 2008,
and the newer
AUSA. The
Probation
officer came
down to the
courtroom.
The
charges or
specifications
were read out:
possession of
a gun,
consorting
with a felon
who had a gun,
and marijuana.
Since
Orozco is
still legally
in state
custody, no
bail argument
was made.
Judge Kaplan
will see Eric
Orozco on May
31 at 11
am.
The
case is US v.
Orozco,
08-cr-52
(Kaplan /
Moses)
